Information on the right of withdrawal
Who has this right
The right of withdrawal belongs to a Consumer - a natural person entering into a contract not directly connected with their business or professional activity - and also to a natural person running a business where the contract is not of a professional character for them (art. 7aa of the Polish Consumer Rights Act of 30 May 2014).
The Provider does not ask for any declaration about the professional character of the purchase and does not make the contract conditional on one. Legal persons and organisational units, as well as natural persons buying for professional purposes, have no statutory right of withdrawal; how to cancel a subscription is described in the Terms.
Deadline
The period is 14 days and runs from the day the contract is concluded, that is from the day the subscription is purchased (art. 27(1) in conjunction with art. 28(2) of the Consumer Rights Act). Premium being unlocked immediately after payment neither shortens that period nor removes the right of withdrawal - the Provider invokes no exclusion of that right against a Consumer.
How to withdraw
It is enough to send the Provider an unequivocal statement of withdrawal - by e-mail to: support@load-fit.com
You may use the model form below, but you do not have to - any unequivocal statement is enough. Sending the statement before the deadline expires is enough to meet it. The Provider will confirm receipt to the same e-mail address. Withdrawal requires no reason, no justification and no paper, and costs you nothing.
Effects of withdrawal
The contract is treated as never concluded. The Provider refunds the whole payment received no later than 14 days from the day the statement is received, using the same means of payment as for the purchase, unless the Consumer expressly agrees to another means of refund that costs them nothing (art. 32(1) of the Consumer Rights Act).
No charge is deducted from the refund for the time Premium was used before the withdrawal and the Provider bills the Consumer nothing on that account, even though art. 35 of the Consumer Rights Act allows payment in proportion to the service provided. The refund is full.
From the moment of withdrawal access to Premium features ends and the workspace moves to the Free plan. Saved projects, vehicles and cargo items are not deleted - they stay available within the Free plan.
The contract is governed by Polish law. Where the mandatory provisions of the country of the Consumer's habitual residence give them wider protection, those provisions apply.
